By using our service or accessing our website, you acknowledge and agree to the following terms and agree to be bound by the following Terms of Service and the Privacy Policy. This terms of service are legally binding and govern your use of our website and service.
If you do not agree with any part of the Terms of Service or the Privacy Policy, please stop using our website and service immediately.
We may amend our Terms of Service or Privacy Policy from time to time and post on this website. You are requested to visit our website regularly to read these changes to our Terms of Service and Privacy Policy. To continue using our website and service, you must agree to all such changes.
1. Copyrights and Other Intellectual Property
All content present on this Website is the exclusive property of Anindya Sundar Mandal, including all the software, text, articles, images, graphics, video and audio used on this Website. ‘Speedify.tech’ is the name, trademarks, and brand which belong to and are owned by Anindya Sundar Mandal. These trademarks and logos may not be used in any manner without prior written consent from Anindya Sundar Mandal.
2. Username and Password Security
We encrypt your password using industry standard. However, you are responsible for maintaining the privacy of your username and password, if any, and you are solely responsible for all activities that occur under your username and password. Speedify.tech WILL NOT BE RESPONSIBLE FOR ANY LOSS OR DAMAGE ARISING FROM YOUR FAILURE TO SUFFICIENTLY SAFEGUARD YOUR USERNAME AND PASSWORD.
3. Use of this Website
All the content included in this Website is solely for the personal or commercial use of website users. You may not copy, modify, distribute, transmit, display, perform, reproduce, transfer, publish, license, or sell any of the contents of this Website and the app (client) without the prior written consent of Anindya Sundar Mandal. Unauthorized use of the materials appearing on this Website may violate copyright, trademark and other applicable laws, and could result in criminal or civil penalties.
4. Links to Third-Party Websites
Some of the links on Speedify.tech may allow you to leave the Speedify.tech website. Third-party sites to which Speedify.tech site may link (“Third-Party Linked Sites”) are not in any way under our control, and WE DO NOT TAKE ANY RESPONSIBILITY OR LIABILITY FOR ANY INFORMATION, CONTENT, COMMUNICATIONS, SERVICES, GOODS OR OTHER MATERIALS AVAILABLE ON SUCH THIRD-PARTY LINKED SITES OR FOR ANY CHANGES OR UPDATES TO SUCH SITES.
5. Payment Terms
The Website Speed/Performance Optimization Service offered by Speedify.tech is entirely paid service. Please read our packages for pricing of the service. Alternatively, you may contact us, tell us your requirements, and we’ll send you a quotation. You need to make the full payment in advance to start working.
6. Refund Policy
By purchasing our service, you acknowledge that you have read and agree to the following refund policy. If you do not agree with any part of the refund policy, please stop purchasing service immediately.
You get a refund if we fail to improve your website’s (home page) ‘optimization’ score at Google PageSpeed Insights (https://developers.google.com/speed/pagespeed/insights). Here ‘improve’ means increase the average ‘optimization’ score by two from the average ‘optimization’ score which we reported to you by email before the start of our work. Google PageSpeed Insights’ optimization score may vary from time to time on the same website even if no changes have been made on the website. So, we run the test ten times and take the average. Google PageSpeed Insights’s any parameter other than ‘optimization’ or ‘Lighthouse’ is NOT applicable to measure the improvement. Field Data, Origin Summary or The Chrome User Experience Report are also NOT applicable to measure the improvement because these are beyond our control.
If you are eligible for a refund, you need to claim it within seven days from the day we complete the work. We’ll calculate the refund amount by deducting the transaction fees charged by PayPal, Bank or any other financial institution involved in your payment. Our bank’s base currency is Indian Rupee. The ‘refund’ means the 120% calculated on the net amount we receive in Indian Rupee (INR / ₹). The refund will be done to the payment source.
You are NOT eligible for any refund for anyone (or more) of the following cases:
(a) You purchased the NOVICE package. This package doesn’t include many things which are crucial for the ‘optimization’ score. So, for this package, we can’t guarantee an improvement in ‘optimization’ score. The same logic is applicable if you customized your package in such a way that it doesn’t include all optimization items listed in the WORDPRESS PRO or PRO package.
(b) You have not accepted at least one of our suggestions to make the required changes to your website, maybe it’s the core design of your website.
(c) Your website’s ‘optimization’ score (performance/Lighthouse data) suffers due to slow ‘server response time’ as per Google PageSpeed Insights. Slow ‘server response time’ is an outcome of poor web hosting services.
(d) As per Google PageSpeed Insights, your website’s ‘optimization’ score (performance/Lighthouse data) suffers due to any script/file which is hosted on external domain/s (e.g., Google Analytics, Google Maps, Google Tag Manager, Cloudflare, etc.), which is beyond our control.
(e) You have not provided your website’s admin login details, and web hosting login details within one year from the date of you made the payment. That means you have failed to use our service for whatever reason despite the payment.
(f) You have made any changes to your website during our work or/and after we complete the optimization work.
(g) We have increased the average ‘optimization’ score on the home page of your website by two or more.
7. Revisions and Changes Policy
Once you place an order, we’ll assign a web developer to the project. You are deemed to have read the progress emails sent by the web developer. Upon complete or delivery (where applicable) the final work service, you shall have seven days to request revisions and changes. After the seven days have passed, the project shall be closed, and no further revisions and changes will be made.
8. Communications
Communications are made via email to the email address provided to Speedify.tech by the user. All emails shall be believed to have been received upon dispatch.
9. No Warranty
THE INFORMATION AND THE SERVICE ARE PROVIDED “AS IS” WITH NO WARRANTY OF ANY KIND, AND YOU USE THE SERVICE AT YOUR OWN RISK. THE SCOPE OF WORK OF THE ASSIGNMENT IS PROVIDED BY AND IS THE RESPONSIBILITY OF THE PERSON SUBMITTING SUCH ASSIGNMENT. Speedify.tech does not represent that all information provided on the website and the official blog it is accurate, correct, complete, reliable, or otherwise valid. Speedify.tech does not endorse or recommend, and expressly disclaims liability for any service, product, manufacturer, distributor, service or service provider mentioned in any document produced by us. Further Speedify.tech does not endorse or support any opinion expressed in our work product.
10. Disclaimer
THE SITE including, ALL THIRD PARTY LINKED SITES and ALL SERVICES, CONTENT, and MATERIALS PROVIDED IN THE SITE ARE PROVIDED TO YOU ON AN “AS IS, WITH ALL FAULTS” BASIS, AND YOUR USE OF SUCH SITES, SERVICES, CONTENT AND MATERIALS IS AT YOUR OWN RISK. Speedify.tech DISCLAIMS ALL WARRANTIES WHETHER EXPRESS OR IMPLIED INCLUDING WITHOUT LIMITATION TO THE WARRANTY OF MERCHANTABILITY, FITNESS FOR PARTICULAR PURPOSE, TITLE, INFRINGEMENT, AND QUIET ENJOYMENT.
11. Limitation of Liability
IN NO EVENT WILL Speedify.tech AND/OR ANY OF ITS PARTNERS, PROVIDERS, AFFILIATES, INCLUDING THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES OR REPRESENTATIVES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, RELIANCE, COMPENSATORY, OR PUNITIVE DAMAGES OR DAMAGES RESULTING FROM LOST PROFITS, LOST DATA OR BUSINESS INTERRUPTION ARISING OUT OF THE USE, INABILITY TO USE, OR THE RESULTS OF USE OF THE SITE. THE SERVICES AVAILABLE ON THE SITE, ANY WEBSITES LINKED TO THE SITE, THE MATERIALS OR INFORMATION CONTAINED AT THE SITE OR THE PREVIOUS LIMITATIONS OF LIABILITY CONSTITUTE A FUNDAMENTAL BASIS OF THIS TOU AND Speedify.tech WOULD NOT HAVE PERMITTED YOU TO USE THE SITE OR THE SERVICES ABSENT SUCH LIMITATIONS.
12. Changes to website and services
Speedify.tech reserves it’s right to change, suspend, discontinue or terminate any aspect of the services in part or whole at any time, including the availability of any of the website features, delivery services, databases or its content thereof without prior notice.
13. Rejection policy
By purchasing our service, you acknowledge that you have read and agree to the following rejection policy. If you do not agree with any part of the rejection policy, please stop purchasing service immediately.
Speedify.tech reserves it’s right to reject any project before start working. In that case, if you already made the payment, we’ll refund you the full amount (not 120%) we receive in Indian Rupee (INR / ₹). The refund will be done to the payment source. If we reject, we’ll do so as soon as possible, however, it may take up to seven days of placing the order. The rejection may be done thereof without prior notice. Generally, the cause of rejection is if your website is already optimized and there is no scope to optimize further. But the reason may not be limited to this and in that case, Speedify.tech is not liable to explain you the cause.
14. Applicable Laws
You agree and submit yourself to the jurisdictional statutes and laws of India, without regard to the conflicts of law principles, will govern all matters relating to these terms of service or your use of the website. This agreement is in person to person basis and is non-transferable, and you may not assign your rights or obligations to any third party on your behalf.
